Foreclosure: Nobody is Safe
From now until the end of 2010, there are expected to be a total of 1.2 million foreclosure actions filed in the State of Florida. The sheer volume of lawsuits means that some filings invariably will contain mistakes. Some mistakes are harmless and can be easily remedied, while some can create nightmarish scenarios and even impact non parties. Take for instance the following recent telephone conversation I had with a friend.
“They made a mistake!”
“Who made a mistake?”
“The bank made a mistake! They’re going to sell my house next week. They mixed up my address with my neighbors”
Sure enough, the Plaintiff’s Motion for Summary Final Judgment contained a serious error. The Plaintiff had erroneously transposed the Defendant’s address with an innocent non party, the next door neighbor. I contacted the Plaintiff and informed them of their blunder, who in turn cancelled the sale of the property and were forced to re-file the lawsuit-this time making sure to include the correct legal description of the property.
